Terms & Conditions & Privacy Policy
Effective Date: 01/09/2025
South West Collective (“we,” “our,” “us”) provides digital marketing, content creation, ads management, and related services. By using our website or engaging our services, you agree to the following Terms & Conditions and Privacy Policy.
1. Services
We provide digital marketing and creative services tailored to your business needs.
Deliverables and timelines are dependent on the client meeting the responsibilities outlined in Section 3 (Client Responsibilities), including timely feedback, approvals, and access to required materials.
Ad spend is billed separately and remains the client’s responsibility.
2. Payments
All services, packages, and projects must be paid upfront to secure your booking.
For ongoing monthly packages, invoices are issued in advance at the start of each month and are payable within 7 days.
For one-off projects, workshops, or content shoots, invoices must be paid in full prior to the scheduled date.
Late payments may result in suspension of services and/or late fees.
Work will not commence until the agreed payment or deposit (if applicable) has been received.
Cancellations made within 7 days of the scheduled service are non-refundable. Cancellations made earlier may be credited towards a future booking at the discretion of South West Collective.
Missed or no-show bookings are non-refundable.
3. Client Responsibilities
Clients must provide accurate information, timely feedback, and access to accounts, platforms, and brand assets. South West Collective is not responsible for delays caused by missing or incorrect information.
To ensure projects run smoothly and results are delivered effectively, clients are also responsible for:
Providing required information, feedback, and approvals within agreed timeframes.
Allowing a minimum of 10 days’ notice for new campaigns, strategy changes, or significant updates. While every effort is made to action requests promptly, this buffer ensures work is planned and executed properly.
Allowing a minimum of 14 days’ notice if new content needs to be filmed or photographed by South West Collective, to allow time for shooting, editing, captioning, and preparation.
Responding to content approvals within 3 business days, unless another timeframe is agreed in writing.
Providing accurate business information, key messaging, offers, product or service details, and any relevant context required to create captions, campaigns, and content that is factually correct and aligned with the business.
Understanding that South West Collective provides expertise in digital marketing, content strategy, paid media, and audience behaviour, while the client remains the expert in their own business, products, services, and industry. As such, client input is required to ensure accuracy and effectiveness.
Understanding that delays in providing content, feedback, approvals, logins, or access may result in extended turnaround times, paused progress, or rescheduled deliverables.
South West Collective cannot be held responsible for reduced performance, missed deadlines, or inaccuracies caused by late responses, incomplete information, or lack of required input from the client.
4. Intellectual Property
Upon full payment, final deliverables (content, designs, ads, etc.) belong to the client.
We reserve the right to showcase non-confidential work in our portfolio and marketing unless otherwise agreed.
5. Cancellations & Termination
Either party may terminate services with 30 days written notice.
All completed work up to the termination date remains payable.
6. Limitation of Liability
We aim to deliver excellent results but cannot guarantee specific outcomes (e.g. sales, leads, rankings).
We are not liable for indirect, incidental, or consequential damages resulting from the use of our services.
